Bail Bonds and Warrants in Florida
Bail Bonds
Bail bonds can be obtained for a person who is facing incarceration until his or her trial begins if a judge sets a bail amount. A bail bond allows for 10% of the total bail amount to be paid up front with the promise that the person whom the bail is posted for will appear on his or her court date. Failure to appear would mean that the person would then be liable to pay the full amount of the original bail set and could then have a warrant issued for his or her immediate arrest. Bail bonds are often obtained through a bail bondsman or agency that can typically be reached 24 hours a day, seven days a week.
Arrest Warrants
An arrest warrant, also known as a capias warrant, may be issued for a person who has being accused of committing a misdemeanor crime outside of the view of law enforcement. However, a signed affidavit must be first obtained stating that a crime was committed and that the person whom the arrest warrant is being issued for is the suspected person who committed the crime. Unlike a misdemeanor offense, felony offenses do not require that an arrest warrant be obtained in order for law enforcement to make an arrest.
Bench Warrants
Bench warrants are issued against a person who fails to show up for a court appearance as promised. Law enforcement will make an immediate arrest when they find the person named on the bench warrant.
Violations Warrants
If a person violates his or her probation terms, a violation warrant may be issued for his or her immediate arrest. It is very important to contact a lawyer immediately upon hearing that a violation warrant has been issued. Many times a Sarasota or Tampa warrants attorney at our firm can help clients avoid a jail or prison sentence and additional penalties altogether.
