Tampa & Sarasota Restraining Order Attorneys
Have you been served a restraining order? If the answer is “yes” then you should seek legal advice immediately. Restraining orders are issued by either law enforcement or a judge and are used to protect alleged victims of violent crimes such as domestic violence, assault & battery, kidnapping, child abuse, elder abuse, spousal abuse, hate crimes or sex crimes. A restraining order is obtained in an effort to protect an alleged victim of a crime immediately. It is an order stating that a person must stay a certain distance away from the alleged victim as well as the victim’s place of residence, employment, education, family, friends and anywhere else they may frequent. Failure to follow the specifics of a restraining order may result in an immediate arrest and incarceration.
Types of Restraining Orders in Florida
In the state of Florida there are different types of retraining orders that may be granted. The first type of restraining order is an Emergency Protective Order (EPO). It is the quickest restraining order to obtain and is typically used for domestic violence or assault situations. The second type of restraining order is a Temporary Restraining Order (TRO). This type of restraining order is first enforced for a few weeks but can then be made permanent for up to 3 years. A Criminal Protective Order (“No contact” order) can be obtained for active domestic violence cases only through the District Attorney’s office. In addition, a person who is simply being harassed by a co-worker, roommate, neighbor or other person can obtain a Civil Harassment Restraining Order, known as a “CHO”.
At Musca Law we protect the legal rights of those facing a restraining order or who have been accused of violating a restraining order. We understand how difficult it can be when you are being told where you can and cannot go. We also understand that if a restraining order was taken out by a loved one or spouse it can be even more overwhelming. If you have children together you will also be required to stay away from them as well, until the judge states otherwise. It is very important that you do not break the rules of a restraining order as it can severely affect the outcome of any criminal case against you.
